Terms of Service

Welcome to Matchig. These Terms of Service ("Terms") govern your access to and use of Matchig's website, AI-powered marketing platform, and related services (collectively, our "Services"). Please read these Terms carefully before using our Services.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.

These Terms constitute a legally binding agreement between you and Matchig, operated by DECode s.r.o., a company registered in Slovakia.

In these Terms:

• "Account" means a unique account created for you to access our Services.
• "Content" means any text, images, data, or other material that you upload, input, or provide while using our Services, including business information used to generate marketing materials.
• "Generated Output" means content, strategies, visuals, or other materials created by our AI-powered Services based on your inputs.
• "Aggregated Data" means data that has been combined, de-identified, and processed in a way that does not identify any individual user or business.
• "Subscription" means the recurring payment plan for access to our Services.

To use certain features of our Services, you may need to create an Account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your Account credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized access to or use of your Account.

We reserve the right to disable any Account, at any time, if we believe that you have violated these Terms or that your Account is being used fraudulently.

Some aspects of our Services may be available on a subscription basis. Payment terms are as follows:

• Subscription fees are charged in advance on a monthly or annual basis, depending on the subscription plan you select.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can cancel your subscription at any time through your Account settings or by contacting us. Cancellation will be effective at the end of the current billing period.
• We may change subscription fees by giving you notice prior to the start of the next billing cycle. Your continued use of our Services after the fee change becomes effective constitutes your agreement to pay the modified fee amount.

All payments shall be processed through our authorized payment processors. We do not store full credit card details on our servers.

Our Services utilize artificial intelligence and machine learning technologies to generate marketing content, strategies, and other outputs based on the information you provide.

5.1 How We Use Your Data

When you use our Services, you provide us with Content that we process to deliver personalized marketing outputs. We use this data to:

• Generate customized marketing strategies, content, and materials for you
• Improve and train our AI models to provide better results
• Develop new features and enhance our Services
• Create aggregated insights and analytics

5.2 Aggregated and De-identified Data

We may create Aggregated Data from information collected through our Services. This data is processed to remove personally identifiable information and cannot be linked back to you or your business. We may use, share, and commercialize Aggregated Data for various purposes, including research, analytics, improving our Services, and providing insights to third parties. This helps us maintain competitive pricing and continuously improve our platform.

5.3 AI Output Limitations

While we strive for accuracy, Generated Output may occasionally contain errors or inaccuracies. You are responsible for reviewing and verifying all Generated Output before use. We do not guarantee that Generated Output will be error-free, suitable for any particular purpose, or compliant with applicable laws in your jurisdiction.

You retain ownership of the Content you provide to our Services. However, by submitting Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and analyze such Content for the purpose of providing and improving our Services, training our AI models, and creating Aggregated Data.

You agree not to use our Services to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Upload or transmit viruses, malware, or other malicious code
• Interfere with or disrupt the integrity or performance of our Services
• Attempt to reverse engineer, extract, or derive the underlying AI models or algorithms
• Generate content that is harmful, misleading, or violates third-party rights

Our Services, including all software, AI models, algorithms, designs, and content created by Matchig, are owned by us and protected by intellectual property laws. These Terms do not grant you any ownership rights in our Services or technology.

Subject to these Terms, you own the Generated Output created specifically for you through your use of our Services. However, similar outputs may be generated for other users based on similar inputs, and we retain all rights to the underlying technology, models, and methods used to create such outputs.

You may not reproduce, distribute, modify, or create derivative works of our Services or any part thereof, except as expressly permitted by these Terms.

Our Services may integrate with or utilize third-party services, including AI providers, payment processors, and analytics platforms. Your use of such third-party services is subject to their respective terms and privacy policies.

We may share data with our partners, service providers, and affiliates to operate and improve our Services, process payments, and deliver relevant features. We require these partners to protect your data in accordance with applicable laws and industry standards.

Matchig is not responsible for the practices or content of any third-party services linked to or integrated with our platform.

To the maximum extent permitted by applicable law, Matchig shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.

Matchig assumes no liability for:

• Any errors, inaccuracies, or unsuitable content in AI-generated outputs or recommendations
• Business decisions made based on Generated Output from our Services
• Any unauthorized access to or use of our servers and stored data
• Any interruption or cessation of our Services
• Any third-party content or conduct on our Services

Our total liability to you for any claims arising from your use of our Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless Matchig, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of our Services, or your Content.

These Terms remain in effect while you use our Services. We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use our Services ceases immediately. We may retain Aggregated Data derived from your Content in accordance with our data practices. You may request deletion of your personal data as described in our Privacy Policy.

Provisions that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, indemnification, and limitations of liability.

We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. Your continued use of our Services after the revised Terms become effective constitutes your acceptance of the changes.

These Terms shall be governed by and construed in accordance with the laws of Slovakia, without regard to conflict of law provisions.

Any disputes arising from these Terms or our Services shall be resolved exclusively through the competent courts of Slovakia, unless otherwise required by mandatory consumer protection laws.
